1. Overview
This website, OPENFIELD GOODS (the "Store"), at ju4emt-yw.myshopify.com and any related domains, is operated by OPENFIELD GOODS ("we," "us," or "our"). These Terms of Service ("Terms") apply to your use of the Store and to any purchase you make from us.
By visiting the Store or placing an order, you agree to these Terms and to our Refund & Return Policy, Shipping Policy, and Privacy Policy, which are part of these Terms. If you don't agree, please don't use the Store.
We may update these Terms from time to time by posting a new version on this page. Changes apply to orders placed after the updated Terms are posted.
2. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order. If you're younger, you may use the Store only with the involvement of a parent or guardian. You agree to provide accurate, current, and complete information when you make a purchase.
3. Our platform
The Store is hosted on Shopify. Payments are processed by third-party payment providers, and we don't store your full card details. Your use of those services may also be subject to their terms.
4. Products and descriptions
We sell tech and travel accessories, including organizers, lighting, speakers, power banks, and chargers. We work to describe and display products accurately. However:
- Colors, sizes, and appearance may vary slightly from photos, and packaging may differ from what's shown.
- Specifications such as battery capacity, wattage, charging speed, and water-resistance ratings are provided by the manufacturer. Actual performance may vary depending on your devices, cables, and how you use the product.
- We don't guarantee that a product will be compatible with every device.
We may change or discontinue products, and limit quantities, at any time.
5. Product safety and proper use
Please read and follow all instructions and warnings that come with your products. In particular:
- Power banks and chargers: Use only as directed and within the stated voltage and wattage limits. Don't use damaged, swollen, or overheating devices. Keep them away from water, extreme heat, and children. Check airline rules before flying with power banks.
- Water-resistant products (for example, IPX7-rated items): Water-resistance ratings apply to fresh water under the specific test conditions. Make sure ports and covers are sealed. Products are not designed for diving, hot water, or saltwater exposure unless stated.
We're not responsible for damage or injury caused by misuse, modification, or use against the product's instructions.
6. Pricing, payment, and errors
- Prices are in US dollars and may change without notice. The price shown at checkout is the price you pay.
- Shipping charges are shown at checkout. Sales tax is added where required.
- Occasionally, the Store may contain errors in pricing, descriptions, or availability. We reserve the right to correct errors and to cancel orders affected by them, even after you've placed your order. If we cancel an order you've already paid for, we'll refund you in full.
7. Orders and acceptance
Your order is an offer to buy. We may accept or decline any order, including for suspected fraud, unauthorized resale, or an inability to verify payment or address details. If we cancel an order after payment, you'll receive a full refund. An order confirmation email confirms that we received your order. It doesn't guarantee that we will accept it.
8. Fulfillment and shipping
Orders are fulfilled by third-party partners and generally ship from overseas. Delivery times are estimates. Please see our Shipping Policy for details. Risk of loss passes to you when the carrier delivers your package to the address you provided.
9. Returns and refunds
Returns, replacements, and refunds are governed by our Refund & Return Policy. If you have a problem with an order, please contact us at str82thebizness@gmail.com before filing a chargeback or payment dispute so that we can try to resolve it quickly.
10. Accounts and acceptable use
If you create an account, you're responsible for keeping your login secure and for activity on your account. You agree not to use the Store for anything unlawful or harmful. That includes attempting to hack, disrupt, scrape, or overload the Store; submitting false information; or infringing the rights of others.
11. Reviews, comments, and feedback
If you submit reviews, comments, photos, or other content, you confirm that it's yours to share and that it isn't unlawful, misleading, or offensive. You give us a non-exclusive, royalty-free license to use, display, and reproduce it in connection with the Store and our marketing. We may remove content at our discretion.
12. Intellectual property
The Store's content, including text, graphics, logos, images, and design, belongs to us or our licensors and is protected by law. You may not copy, reproduce, or use it for commercial purposes without our written permission. Third-party brand names mentioned on the Store belong to their respective owners.
13. Third-party links and services
The Store may link to third-party websites or services. We aren't responsible for their content, policies, or practices.
14. Privacy
Your use of the Store is also governed by our Privacy Policy, which explains how we collect and use your information.
15. Disclaimer of warranties
Except as expressly stated in our policies, and to the fullest extent permitted by law, the Store and all products are provided "as is" and "as available." We disclaim all other warranties, whether express or implied. That includes implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that the Store will be uninterrupted or error-free. Any manufacturer warranty that comes with a product is provided by the manufacturer. Some jurisdictions don't allow certain warranty exclusions, so some of these exclusions may not apply to you.
16. Limitation of liability
To the fullest extent permitted by law, OPENFIELD GOODS and its owners, employees, and partners won't be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Store or any product. Our total liability for any claim related to an order won't exceed the amount you paid for that order. Nothing in these Terms limits liability that can't legally be limited, such as liability for gross negligence, willful misconduct, or personal injury where required by law.
17. Indemnification
You agree to indemnify and hold harmless OPENFIELD GOODS and its owners, employees, and partners from claims, damages, and expenses, including reasonable attorneys' fees, that arise from your breach of these Terms or your misuse of the Store or products.
18. Governing law and disputes
These Terms are governed by the laws of the State of California and applicable US federal law, without regard to conflict-of-law rules. Any dispute that we can't resolve informally will be brought exclusively in the state or federal courts located in San Bernardino County, California, and you consent to their jurisdiction. Either party may bring an eligible claim in small claims court instead.
Before filing any claim, please contact us at str82thebizness@gmail.com and give us at least 30 days to try to resolve the issue informally.
19. Severability and entire agreement
If any part of these Terms is found unenforceable, the rest remains in effect. These Terms and the policies referenced here are the entire agreement between you and us about the Store. If we don't enforce a provision, that doesn't waive our right to enforce it later.
